1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you") and Biohackr LLC, a Texas limited liability company ("Biohackr," "we," "us," "our"), governing your access to and use of the Biohackr application, website at biohackr.pro, and related services (collectively, the "Service").

By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into binding contracts to use Biohackr. By using the Service, you represent and warrant that you meet these requirements.

The Service is intended for personal, non-commercial use only. Use by individuals under 18, or use on behalf of an individual under 18, is strictly prohibited regardless of consent.

3. The Service — What Biohackr Is and Is Not

3.1 What Biohackr Is

Biohackr is a personal data tracking and educational reference tool. It allows you to:

Log substances you choose to use, including dosages, frequencies, and administration sites
Track inventory of substances and supplies you possess
Record bloodwork results you obtain elsewhere
View pharmacokinetic estimates based on standard models
Access educational reference content about substances, including supplements, hormones, peptides, research chemicals, and pharmaceuticals

3.2 What Biohackr Is Not

Biohackr is not a medical device, healthcare service, or medical advice provider. Specifically:

Biohackr does not provide medical advice, diagnosis, or treatment. No content on the Service should be interpreted as medical recommendation.
Biohackr does not have a doctor-patient relationship with you. Using Biohackr does not establish any such relationship.
Biohackr does not endorse, recommend, or sell any substance. Educational content about a substance is not an endorsement of its use.
Biohackr does not verify the legality, safety, or quality of substances you track in your personal records.
Biohackr does not replace consultation with qualified healthcare providers. You should consult a licensed physician before using any substance, especially prescription medications, controlled substances, hormones, or research chemicals.

3.3 Educational Content Disclaimer

The educational content provided in Biohackr's compound library is for informational purposes only and is compiled from publicly available sources. It may include information about:

FDA-approved medications used off-label
Research chemicals not approved for human use
Substances banned by sporting authorities or pharmaceutical regulators
Substances with documented safety risks including potential lethality

The inclusion of any substance in our library is not an endorsement of its use. Some substances referenced in the Service are dangerous, illegal in certain jurisdictions, or have killed users at typical doses. The information is provided so that individuals who have already decided to use these substances can do so with full awareness of documented risks.

4. User Responsibilities and Acknowledgments

By using Biohackr, you acknowledge and agree that:

4.1 Legal Responsibility

You are solely responsible for compliance with all applicable laws regarding any substance you track in the Service, including but not limited to laws regarding possession, importation, prescription requirements, and athletic sanctioning. The Service does not verify, advise on, or facilitate compliance with these laws.

4.2 Medical Responsibility

You are solely responsible for decisions regarding substances you use. You agree to:

Consult qualified medical professionals before initiating any substance use
Obtain regular bloodwork as appropriate for substances you use
Recognize the limits of pharmacokinetic estimates (which are population averages, not individualized predictions)
Discontinue use and seek medical attention if you experience adverse effects

4.3 Accuracy of Data

You acknowledge that:

Information you enter is your responsibility to verify and maintain accurately
Pharmacokinetic estimates and lab reference ranges are approximations, not medical truth
Educational content is compiled from publicly available sources and may contain errors or be outdated
Substance products purchased anywhere (including pharmacies) may be misdosed, counterfeited, or contaminated, and the Service cannot detect this

4.4 No Reliance on Automated Outputs

Predicted serum levels, injection site recommendations, dose timing calculations, and any other automated outputs are estimates based on standard models. You agree not to rely on these outputs as medical truth and to maintain independent judgment regarding your health decisions.

5. Account Registration and Security

To use most features, you must create an account. You agree to:

Provide accurate, current information when registering
Maintain the confidentiality of your password
Notify us immediately of unauthorized access to your account
Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

6. Subscription and Payment

6.1 Pricing

Biohackr offers free and paid subscription tiers. Current pricing is displayed in the Service. We reserve the right to change pricing for new subscribers at any time.

6.2 Billing

Paid subscriptions are billed in advance on a recurring basis (monthly or annually as selected). Your subscription will automatically renew unless cancelled before the renewal date.

6.3 Refunds

We offer a 14-day refund window for first-time paid subscriptions. After this window, payments are non-refundable except as required by law. Annual subscriptions may be cancelled at any time but are not pro-rated.

6.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. Your data remains accessible during this period and for 30 days after cancellation, after which it may be deleted.

7. Prohibited Uses

You agree NOT to:

Use the Service for any unlawful purpose
Use the Service to facilitate the sale, distribution, or trafficking of any substance
Recommend specific substances or doses to other users in any communication channels we may provide
Provide medical advice through the Service if you are not a licensed healthcare provider
Reverse engineer, copy, modify, or create derivative works of the Service
Use automated systems (bots, scrapers) to access the Service without permission
Attempt to bypass security measures or access other users' data
Use the Service if you are under 18 years of age
Resell, sublicense, or otherwise commercialize the Service or its content

8. Intellectual Property

8.1 Our Content

The Service, including all software, content, design, text, graphics, and the Biohackr brand, is owned by Biohackr LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal use.

8.2 Your Content

You retain ownership of the data you enter into the Service. By using the Service, you grant Biohackr a limited license to store, process, and display your data as necessary to provide the Service.

9. Privacy

Your privacy is important to us. Our handling of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimers

10.1 As-Is Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, whether express or implied, including but not limited to:

Warranties of merchantability or fitness for a particular purpose
Warranties of non-infringement
Warranties regarding accuracy, reliability, or completeness of content
Warranties that the Service will be uninterrupted, secure, or error-free

10.2 No Medical Warranty

WE EXPRESSLY DISCLAIM ANY WARRANTY THAT THE SERVICE WILL PROVIDE MEDICALLY ACCURATE OR APPROPRIATE INFORMATION FOR YOUR INDIVIDUAL CIRCUMSTANCES. All decisions about your health remain your responsibility, ideally in consultation with qualified healthcare providers.

10.3 Third-Party Content

The Service may contain links to third-party websites or services (e.g., lab testing providers). We do not endorse, control, or accept responsibility for third-party content.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

Biohackr LLC, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Personal injury or death
Adverse health effects from substances tracked in the Service
Loss of profits, revenue, or data
Business interruption
Costs of substitute products or services

Our total cumulative liability to you for all claims arising out of or relating to the Service shall not exceed the greater of (a) $100 or (b) the amount you paid us in the 12 months preceding the claim.

This limitation applies regardless of the legal theory (contract, tort, statute, or otherwise) and even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Biohackr LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any law or regulation
Your use of any substance, regardless of whether tracked in the Service
Any harm caused to yourself or others by substances or activities tracked in the Service
Your violation of any rights of another party

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including:

Violation of these Terms
Suspected fraudulent, illegal, or harmful activity
Extended account inactivity
Discontinuation of the Service

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (disclaimers, limitations of liability, indemnification, etc.) will survive.

14. Modifications to Terms

We may modify these Terms at any time. Material changes will be notified to you via email or in-app notification at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the modified Terms.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles.

15.2 Arbitration Agreement

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration, administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall be conducted in Dallas County, Texas.

You waive any right to a jury trial or to participate in a class action lawsuit. You may opt out of this arbitration provision within 30 days of accepting these Terms by sending written notice to legal@biohackr.pro.

15.3 Exceptions

This arbitration requirement does not apply to:

Small claims court actions
Claims for injunctive relief related to intellectual property
Claims that cannot lawfully be subject to arbitration

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Biohackr regarding the Service.

16.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

16.3 No Waiver

Our failure to enforce any provision is not a waiver of our right to do so later.

16.4 Assignment

You may not assign your rights under these Terms. We may assign our rights to any successor entity.
